Social Security Disability
There are two basic types of Social Security Disability Benefits. Social Security Disability Insurance (SSDI) is designed for workers who meet Social Security’s definition of disabled and have earned enough credits to qualify. Supplemental Security Income (SSI) is designed to help aged, blind, and disabled people who have little or no income. While these two programs are different in many ways, both are administered by the Social Security Administration and only individuals who have a disability and meet medical criteria may qualify for benefits under either program. How do I apply for benefits?
The process of applying for these benefits can be overwhelming and may require multiple applications and appeals, including a hearing in front of a Federal Administrative Law Judge. Consequently, it is important to have an advocate who can present your claim in the best light possible. Although you are not required to have an attorney represent you in social security cases, attorneys are formally trained in evidence and trial practice. Unfortunately, many people are unaware that non-attorneys can represent claimants in these proceeding. However, non-attorney representatives receive the same fee as an attorney. Therefore it makes sense to have a member of the Florida Bar represent you in these proceedings.
Social Security Regulations permit a fee in the amount of 25% of the back benefits that you receive up to the current maximum of $6,000.00. It is important to know that we represent all SSI/SSDI clients on a contingency fee basis; which means you do not pay any money up front. Instead, if you win, Social Security will deduct 25% of the past due benefits that are you are owed and pay them to us an attorney fee for our work. In addition, if we win you will be responsible for paying any costs such as medical records and copying fees, which may be incurred in handling your claim. However, we will not bill you for these costs unless a favorable decision is made.
